Instructions: There is no estate tax for those dying in 2010. However, only the first $1,500,000 gets a stepped up basis and is excluded from capital gains. Any appreciation over that is taxed at 33%.

WARNING: This calculator cannot be used as a substitute for legal advice. The calculator assumes that the decedent dies in 2009 and makes no significant lifetime gifts. If married, the calculator assumes that the decedent and spouse each own half of every asset. The calculator makes other important (and potentially wrong) assumptions about the estate. The calculator computes federal estate tax, without regard to the federal deduction for state death taxes (only 9 states have death taxes California and Nevada do not). The tax due in any given case may be substantially higher or lower than is shown above, and may vary depending on your state of residence. For deaths in 2008 the Estate Tax, if any will be substantially higher.
